TERMS AND CONDITIONS

All reservations made on Bellevue Accommodation website, other booking agent sites and directly with Bellevue Accommodation are made subject to these terms and conditions and the person making the reservation will be deemed to have accepted these terms and conditions on behalf of all persons who will be staying at Bellevue Accommodation under the reservation was booking confirmed. Reservations may also be governed by and subject to additional terms and conditions.


DEFINITIONS
In these terms and conditions:

“We”, “our”, “us” and “Bellevue Accommodation” mean the same thing. “You” and “your” mean the person who is making the reservation.


IDENTIFICATION
When you check-in, you may be asked to provide photographic identification.


MINIMUM STAY
Minimum stay periods apply, subject to our discretion


RATES & CHARGES
You agree that you will pay to us the room rate for each day of your stay and any additional charges up until the time you advise us that you have departed from our hotel. All prices are quoted in Australian dollars (per room per night and are inclusive of GST.
Prices are subject to availability and can change without notification due to fluctuations in charges and currency. Blackout/special event periods may apply. The “from” rates displayed on the website are indicative rates only, are subject to availability & terms and conditions apply. Please select dates and check availability to get the most up to date pricing. Each rate available via a Bellevue Accommodation website is subject to individual terms and conditions.


CHECK-IN:
FROM 2PM. We will forward a SMS with your apartment entry code and other instructions on the day of arrival. You must advise us of any change in number of persons using room and agree to pay the additional charges.

CHECK-OUT:
10AM. Departure after that time may incur additional charges


PAYMENT POLICY:

10% Deposit (Non-refundable) is required at time of booking.
Balance of payment is due 1 month prior to check-in.

We accept payment by Credit Card :VISA OR MASTERCARD: 2.4% card surcharge fee applies. We also accept payment by Direct Deposit, Cash or EFTPOS. You agree that any charges for services to you, not billed at the time of your departure, may be added to your account for settlement as arranged or may be charged to the same credit card used to pay the account at the time of departure or to the credit card used to guarantee payment of your account.

 

GUARANTEE
Guarantee with a valid credit card is required at time of making a reservation via a Bellevue Accommodation website or direct as well as on check-in to the hotel.


CANCELLATION / REFUND POLICY

If booking cancelled/altered less than 30 days prior to check in: No refunds
If booking cancelled/altered more than 30 days prior to check in: 10% of total tariff forfeited.
Bookings made through all online sites are fully non-refundable.


EXCESS CLEANING FEE
This may include charges for excess cleaning if required. A dishwasher is provided in each room. Washing of soiled plates, pots, cutlery, breakages etc is the guest’s responsibility. Decisions on excess cleaning charge are solely at the discretion of Bellevue Accommodations. A clean up fee will be charged if spillages occur on carpet or bedding. In the event this spillage cannot be removed, a replacement fee will be charged. You agree that any charges for services to you, not billed at the time of your departure, may be added to your account for settlement as arranged or may be charged to the same credit card used to pay the account at the time of departure or to the credit card used to guarantee payment of your account.


NON SMOKING
Bellevue apartments are a non-smoking establishment. This includes rooms, hallways, gardens and verandas. Excess cleaning fees will apply if policy not adhered to.


MINORS
Persons under the age of 18 must be accompanied by a responsible adult.


FACILITIES & SERVICES
Whilst care is taken to ensure that the description of our facilities and services is accurate, these are continually being changed, upgraded, and on occasion taken out of service. If any feature or facility is essential to you in choosing a particular property, it is your responsibility to confirm with the property prior to making your reservation that the feature or facility will be available during your stay. To the extent permitted by law, Bellevue Accommodation is not liable for omissions, errors or changes to the facilities and services at a property, whether temporary or permanent. Accommodation facilities listed may not apply to all room types.


THIRD PARTY PRODUCTS & SERVICES
Bellevue Accommodation sometimes includes third party products or services in special packages and Bellevue Accommodation is not liable under any circumstances for any failure by third party providers to provide products or services, nor for any error, alteration or change of any kind made by those third party providers following acceptance of a booking by them. All third party coupons, vouchers, receipts and tickets are issued subject to the terms and conditions specified by those third parties. Bellevue Accommodation does not warrant the accuracy of any information, statements or representations made by third parties and is not liable for any act or omission, default or negligence of any third party provider.


RELEASES & INDEMNITIES
Any monies or other valuables, goods or vehicles that belong to you, brought in or on to the room, grounds or car park remain your responsibility and we are not responsible for their safekeeping. You agree to pay us for any loss or damage to the room or equipment in the room during period of use. To the extent permitted by law, you agree to release and hold harmless Bellevue Accommodation and its current and former officers, employees and agents against and from all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses, property loss/damage and damage for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your reservation or your stay at the relevant Bellevue Accommodation for any reason whatsoever. You agree to indemnify Bellevue Accommodation and its current and former officers, employees and agents for all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses, property loss/damage and damage for injury, including personal injury and death) incurred or suffered by Bellevue Accommodation or its current or former officers, employees or agents arising out of, caused by, attributable to or resulting from your reservation or your stay at the relevant Bellevue Accommodation except to the except caused or contributed to by Bellevue Accommodation or its current or former officer’s, employee’s or agent’s negligence.
You agree that regardless of your length of stay there is no tenancy or other proprietary rights created under any laws. We grant you a licence to stay in our hotel and we reserve the right to terminate the licence at any time.


PRIVACY POLICY

We are committed to protecting privacy and security of your personal information in accordance with accepted privacy principles as described in this policy.

Information Collected
Whilst visiting the web site of Bellevue Accommodation, our Internet Service Provider makes a record of your visit and logs the following information for statistical purposes:

  • type of browser you are using
  • the previous site you have visited
  • your server address
  • your top level domain name (for example .com, .gov, .au, .uk etc)
  • pages accessed and documents downloaded

Access to Information Collected
Bellevue Accommodation will not make an attempt to identify users or their browsing activities. However, in the unlikely event of an investigation, a law enforcement agency may exercise its legal authority to inspect our Internet Service Provider’s logs. Access to your personal data can be obtained by requesting information by emailing book@bellevueaccommodation.com.au

Use and disclosure of Information Collected
We will not disclose information about your individual visits to our Web site or any of the personal information that you provide such as your name, address, telephone number, e-mail address or credit/debit card details to any outside parties without your consent, except when required by law to do so.

We will record your name, address, phone number & e-mail address if you send us a message. This information is utilised as part of the guest booking process. This information may be added to our database. From time to time we may contact you as part of marketing campaigns. If you do not wish to be part of marketing campaigns please email us and we will unsubscribe you from data base. We never pass on this information to outside sources unless you specifically request such an action. Users are advised that there are inherent risks transmitting information across the Internet.

We may offer links to sites that are not operated by Bellevue Accommodation. If you visit one of these linked sites, you should review their privacy and other policies. We are not responsible for the policies and practices of these external links.


SECURITY POLICY

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment. We use SECURE PAY who provide a highly secure Payment Card Industry Data Security Standard (PCI DSS) compliant solution. SHORT TERM RENTAL ACCOMMODATION POLICY

Short-term rental accommodation (STRA) offers accommodation for a limited period of time in a privately-owned dwelling.

What guests need to know
Short-term rental accommodation that operates within a residential setting must not negatively impact neighbouring residents. All guests and their visitors must comply with Kiama Council’s Short-term Rental Accommodation Policy. The managing agent of this STRA is expected to provide guests with a copy of the policy and explain it to guests at the time of their arrival. By proceeding with this booking you acknowledge you have been made fully aware of the policy. Should you require clarification of any part of the policy please contact us for a detailed explanation. Guests and their visitors must not create noise that is offensive to neighbours.

Guests are expected to:

  • 􏰀 Keep noise to a minimum, particularly between 10pm and 8am.
  • 􏰀 Make sure visitors comply with the Short- term Rental Accommodation Policy
  • consider neighbour’s health, safety and privacy.
  • 􏰀 Use bins provided as putting domestic rubbish into public bins can result in fines.
  • 􏰀 Separate waste into recyclable, organic and general garbage and dispose of in the appropriate bins.

Guests must not:

  • 􏰀  allow more than two adults per bedroom to stay at the STRA
  • 􏰀  invite an unreasonable number of visitors to the STRA
  • 􏰀  park vehicles in a way that disrupts or inconveniences neighbours
  • 􏰀  use decks, balconies, verandas, outdoor spas, pools, or BBQ areas between 10pm and 8am.

Neighbours rights

  • Neighbouring residents have the right to make a complaint about breaches to the STRA policy.
  • They can contact the STRA’s managing agent 24 hours, 7 days a week to lodge a valid complaint.
  • The managing agent is required to notify Council within 48 hours of any complaint or issue.
  • Council will assess the nature of the complaint and take any necessary action. This may include:
  • 􏰀 issuing a Penalty Infringement Notice
  • 􏰀 terminating occupancy of the STRA
  • 􏰀 preventing the residence from operating as a STRA.

A copy of this policy is provided in the compendium in each apartment.


GENERAL
These terms and conditions are governed by and will be construed in accordance with the laws of the State of New South Wales, Australia. Nothing in these terms and conditions affect any rights you may have and which by law cannot be excluded, including under the Competition and Consumer Act 2010 (Cth) and under State and Territory consumer protection legislation.
